While the surrounding states Illinois, Michigan, & Ohio have legalized some form of marijuana it is still completely illegal Indiana including medical marijuana. Even possessing small amounts, cultivating plants, and/or distributing marijuana is seen as violating the laws against a schedule I drug in Indiana. In addition, it is illegal to possess or sell drug paraphernalia in Indiana. This includes items to cultivate plants or items that are typically used to consume said drugs.

Below are some of the common penalties associated with Marijuana:

  • Possession of Marijuana, Less than 30 Grams: Class A misdemeanor
  • Possession of Marijuana, More than 30 Grams: Level 6 Felony
  • Cultivation/Distribution of Marijuana, Up to 30 Grams: Class A Misdemeanor
  • Cultivation/Distribution of Marijuana, Up to 10 Pounds: Level 6 Felony
  • Cultivation/Distribution of Marijuana, More than 10 Pounds: Level 5 Felony

Indiana Methamphetamine, Cocaine, & Narcotic Drug Charges

In Indiana, you can be charged with “actual” or “constructive” drug possession. If drugs are found in your home, this may be enough for law enforcement to establish that you had intent, capability, and control over the illicit substance, which could lead to a “constructive” possession charge.

  • Possession of Cocaine or Methamphetamine, More than 3 Grams: 2-8 years imprisonment and fines up to or more than $10,000
  • Distributing Less than 1 Gram of Cocaine, Narcotics, or Methamphetamine: 1-6 years in prison
  • Distributing 1-5 Grams of Cocaine, Narcotics, or Methamphetamine: 2-12 years in prison
  • Distributing 5-10 Grams of Cocaine, Narcotics, or Methamphetamine: 3-16 years in prison
  • Distributing 10 or More Grams of Cocaine, Narcotics, or Methamphetamine: 10-30 years in prison
